Terms of use

Part B is an English translation of the Association’s public offer for donations, provided for convenience. The Ukrainian version is the legally binding text; if the two differ, the Ukrainian version prevails.

Part A. Using this site

A1. What the Site is

The website aptc.org.ua (“the Site”) is published by the non-governmental organisation “Association for the Prevention of Traumatic Childbirth” (ГО «АПТП», EDRPOU code 45392715; “the Association”). By using the Site you accept these terms.

A2. Information, not medical advice

The materials on the Site are for information. They do not replace a consultation with a doctor, midwife, psychologist or other qualified professional, and they are not a diagnosis or a treatment plan. In an emergency, call your local emergency number.

A3. The specialist registry

The registry lists practitioners and the education and documents they have provided. Specialists work independently: an appointment is an arrangement between you and the specialist, made through her own channels, and the Association is not a party to it and receives no fee for it.

A4. Content and links

The texts, drawings and design of the Site belong to the Association unless stated otherwise. You may quote and share them for non-commercial purposes with a link to the source. The Site links to other websites; the Association is not responsible for their content or their privacy practices.

A5. Changes

We may update these terms. The current version is always published on this page with its date. Personal data is handled under our Privacy policy.

Part B. Terms of donation (public offer)

1. General provisions

1.1. This document is a public offer by the non-governmental organisation “Association for the Prevention of Traumatic Childbirth” (ГО «АПТП», EDRPOU code 45392715; “the Association”) to conclude a contract of voluntary donation on the terms below, in accordance with Articles 633 and 641 of the Civil Code of Ukraine.

1.2. The contract is concluded with any individual or legal entity that transfers funds to the Association’s account (“the Donor”).

1.3. Transferring funds to the Association’s account by any of the methods listed on the Donate page is full and unconditional acceptance of this offer. The contract is concluded when the funds are credited to the Association’s account.

2. Subject of the contract

2.1. The Donor voluntarily and free of charge gives the Association money (a donation), and the Association accepts it and uses it for its statutory activities.

2.2. A donation is not payment for goods or services and gives the Donor no benefit of any kind.

2.3. If the Donor does not state a specific purpose in the payment reference, the Association decides how to use the funds within the aims set out in its Statute.

3. How to donate

3.1. The Donor decides the amount of the donation.

3.2. A donation can be made:

  • by bank transfer to the Association’s account, using the details in section 8;
  • by other methods the Association lists on the Donate page (including card payment through a payment service, once it is connected).

3.3. In the payment reference we recommend stating “Charitable donation” and the Donor’s name.

3.4. Any bank or payment-service fee for the transfer is paid by the Donor according to their bank’s tariffs.

4. Rights and obligations

4.1. The Association undertakes:

  • to use the funds received solely for its statutory activities;
  • to publish annual reports on its activities and finances in accordance with its Statute;
  • to provide information on the use of a donation at the Donor’s request.

4.2. The Donor has the right:

  • to receive information about the Association’s activities and the use of funds;
  • to state the purpose of the donation in the payment reference.

5. Refunds

5.1. A donation is non-refundable.

5.2. If funds were transferred by mistake (a wrong amount or an error in the details), the Donor may contact the Association at [email protected] within 14 calendar days of the transfer, attaching proof of payment. The Association will consider the request and, where justified, return the funds less bank fees.

6. Personal data

6.1. By making a donation, the Donor consents to the processing of the personal data the Association receives from the bank or payment service (name, amount, date and payment reference) for recording donations and reporting.

6.2. Personal data is processed as described in the Privacy policy.

7. Other terms

7.1. Matters not covered by this contract are governed by the law of Ukraine.

7.2. Disputes are settled by negotiation and, failing agreement, in the manner established by the law of Ukraine.

7.3. The Association may change the terms of this offer. A new version takes effect when it is published on the Site and does not apply to donations made earlier.
